Negative Forces Are Weakening Indian Judiciary

The Madras High Court Judge R Reghupati revelation has sent ripples in the Indian political scenario.He has accused a Union minister of threatening him.The whole episode has created a very embarrassing situation for the UPA government.

Anyway,I have referred to this episode merely to highlight that while we criticize, condemn and ridicule judiciary we never bother to take note of the problems faced by the Courts.It’s true that legal hassles and unwanted delays have prevented people from knocking the doors of justice.Commenting upon the dark images of judiciary Fali S.Nariman stated that courts should be judicious while dealing with contempt proceedings.Often the proceedings are viewed in wrong light by the executive and legislature,who take them as an assault upon their powers.

However,there are complexities ,which need to be tackled to provide judiciary a breather.The real culprits are the block roads in executive and legislature whose ability to twist and blunt the legal verdicts has resulted in abnormal delays.After all, the Apex court has left no stone unturned in providing speedy justice the victims and that too in a balanced way .However,the foul practices in other two wings ensure that judgments either lose their significance or get torn into pieces by roadblocks set by them .

Remember,the way Delhi government tried all tricks in its book to circumvent the Delhi High Court order dealing with demolition of illegal buildings in Delhi?Or,for that matter,just look at the way reservation policies are being twisted to suit the whims and fancies of our worn-out netas.Against this backdrop, instead of mindless criticism of the judiciary ,it’s time to strengthen its elements to end the dominance of unholy powers .

I agree with your view Puneet.It’s really disturbing.Remember Shah Bano case?

The legislative is always head on with judiciary.Thanks God ! The Supreme Court has made it clear that it has power to examine and amend controversial Bills passed by the government if they are not on par with Constitutional provisions.

No,my friend you are absolutely wrong.Indian judiciary is still going strong.It’s still the last refuge of ordinary citizens and their faith in judicial system is intact.That’s why Indian courts are overburdened. All of them are interested in solving the disputes via court.

Indian Judiciary is going strong? Leaders are influencing the decisions. Judges are indulged in corruption. Judges are not ready to declare their assets. Is this the way Indian judiciary is going strong?

Who told you that leaders are influencing the decisions? I agree there have been incidents,wherein wrong elements have influenced the process of judiciary.

But to say that Indian judiciary is losing its hold is baseless.Don’t worry about declaration of assets.They will declare them soon.

Most of the problems faced by the court is because of the blunders committed by the investigative agencies, greedy lawyers and stupid application of mind by the judicial officers in the lower courts.Well, it’s time to have qualified lawyers from the bar as judges in higher court to ensure fair and speedy trial.

Anyway,the judgments by Indian courts still act as guiding stars for Courts across the globe !!

It had happened at the High Court level when Lower Courts are worst. The Ghaziabad Judiciary had been in the Lime light Some of the Original Files are missing from the record Room with crucial Original papers, but Allahabad High Court or District Judge had not handed over the case to Police. He was suppose to lodge a FIR for missing record as it amount to theft, I M one of the Victim for the last 15 years .

The Supreme Court has taken note of it and ordered a CBI enquiry.The Judges involved in it are now at the receiving end of tough actions.

An impeachment process has been initiated against Calcutta High Court Judge Justice Soumitra Sen for misappropriating large sums of money.

The above examples are indicative of fact that guilty judges are bound to get heavy punishment.

It is A PF case in which Govt Money is involved. the Missing file case has not yet opened as District Judge Ghaziabad has not lodged any FIR.There is no hearing in last 10 years in my case .

One Mr. Naresh Tyagi who was keeping the record removed files which pertain to the recovery of the Bank Loan, this man took a premature retiremnent and now practicing as an Advocate , at Ghaziabad. I had approached Allahabad High Court, about 3 years back. but no further hearing has been fixed, by District Judge Ghaziabad. so Lower Courts are worst.when it remain vacant for months .

You seem to have brought it in the notice of HC.What happened after that ?Didn’t the HC grant U some relief? Or if the lower court didn’t ensure it’s compliance didn’t you file a contempt petition ?
