
The criminal justice system have not had near-perfect rendezvous with citizens wishing to have a judiciary devoid of flaws.The writing on the wall is clear:Overhaul the judicial system by eliminating the loopholes which provide wrong elements the power to manipulate the criminal procedures.In fact,the Malimath Committee has suggested many ways to bring legal system back on tracks including the one’s which prevent witness from turning hostile.However,it’s not fair to downplay the image of judiciary by painting it in wrong colours.

When all others dimensions of democracy have fallen prey to negative loopholes in society , there is hardly any merit in ascribing sacredness to the judicial system.The real culprits are the investigative agencies whose work culture led SC to remark in of the cases that”they are not interested in carrying out the investigations in fair manner”.Even in Jessica Lal murder case the closed-box mindset of the elite class, which refused to deliver real version of the incident before the court and the shoddy attitude of top police officials reduced the chances of justice being done in time.

Let me state that Indian judiciary has the ability,despite delays and legal complexities,to bring justice to the doors of victims.It still vouches for providing effective relief to the sufferers.The image of judiciary in common people’s eyes seems to be governed by fallacious interpretation of court’s verdict.When it refused to bow down to the star-appeal of Salman Khan in Chinkara killing case,media felt that celebrities are becoming victim of their high -position in the society!The media forgot that the court delivers the verdict in light of the evidences brought before it and not on basis of ‘who’s who’.It seems that even when one works efficiently to ensure speedy justice,there are always double -edged opinions to sabotage the courageous spirit.Refusing to be bowed down by the ’star appeal’ of Salman Khan,the Jodhpur trial court held him guilty of killing endangered Chinkara,landing this man behind the bars for 5 years.It’s enough to sent shock waves in those who feel that they have the power to dodge legal institutions.

Similarly,B.H. Mohanti,the son of high -profile police official of Orissa Cadre was sentenced 7-year prison term for outraging the modesty of German girl.The Mumbai High court came to the rescue of Bar girls by quashing the notification of Maharastra government,calling it to be ‘discriminatory’ and ‘unconstitutional’.Lastly,the Best Bakery judgment bears testimony to fact that judiciary has the capacity to bring justice to the doors of sufferers.

These various judgments clearly suggest that judiciary has retained the capacity to make real and meaningful difference in lives of sufferers.
