The criminal justice system have not had near-perfect rendezvous with citizens wishing to have a judiciary devoid of flaws.The writing on the wall is clear:Overhaul the judicial system by eliminating the loopholes which provide wrong elements the power to manipulate the criminal procedures.In fact,the Malimath Committee has suggested many ways to bring legal system back on tracks including the one’s which prevent witness from turning hostile.However,it’s not fair to downplay the image of judiciary by painting it in wrong colours.

When all others dimensions of democracy have fallen prey to negative loopholes in society , there is hardly any merit in ascribing sacredness to the judicial system.The real culprits are the investigative agencies whose work culture led SC to remark in of the cases that”they are not interested in carrying out the investigations in fair manner”.Even in Jessica Lal murder case the closed-box mindset of the elite class, which refused to deliver real version of the incident before the court and the shoddy attitude of top police officials reduced the chances of justice being done in time.

Let me state that Indian judiciary has the ability,despite delays and legal complexities,to bring justice to the doors of victims.It still vouches for providing effective relief to the sufferers.The image of judiciary in common people’s eyes seems to be governed by fallacious interpretation of court’s verdict.When it refused to bow down to the star-appeal of Salman Khan in Chinkara killing case,media felt that celebrities are becoming victim of their high -position in the society!The media forgot that the court delivers the verdict in light of the evidences brought before it and not on basis of ‘who’s who’.It seems that even when one works efficiently to ensure speedy justice,there are always double -edged opinions to sabotage the courageous spirit.Refusing to be bowed down by the ’star appeal’ of Salman Khan,the Jodhpur trial court held him guilty of killing endangered Chinkara,landing this man behind the bars for 5 years.It’s enough to sent shock waves in those who feel that they have the power to dodge legal institutions.

Similarly,B.H. Mohanti,the son of high -profile police official of Orissa Cadre was sentenced 7-year prison term for outraging the modesty of German girl.The Mumbai High court came to the rescue of Bar girls by quashing the notification of Maharastra government,calling it to be ‘discriminatory’ and ‘unconstitutional’.Lastly,the Best Bakery judgment bears testimony to fact that judiciary has the capacity to bring justice to the doors of sufferers.

These various judgments clearly suggest that judiciary has retained the capacity to make real and meaningful difference in lives of sufferers.

Most of our States are still following the British Colonial police Act, 1861 as is; while others have passed laws which are heavily based on the aforesaid Act. Since independence we have recognized the need for reforms of police and criminal justice in India and we have seen many commissions and committees, right from National Police Commission set up after emergency in 1979, but none of those suggestions ever seen the day light and the reports are covered with dust in government shelves without implementation. Apparently, this Malimath committe has very well paid attention to recommend required amendments in CrPC so as to include some of the key suggestions of National Police Commission. What we lack is a Govt with a will power to implement it.

My dear friend, I strongly disagree with your view.No need to stress the reasons in this regard as that would mean repetition of examples presented in the article.Such gross generalization merely creates wrong impression.I hope you realize that.

The evidence put before the Court should be fool proof as described in the Cr P C. , Police can implicate the honest people and it is famous in fake encounters. Police is not taking interest in Investigation properly. Take any case Nithari Noida case . or Arushi Murder case. Witnesses are not respected in the Court by giving them proper Facility . The Reports of Police Commissions , have not given any relief to the Witness, who play a crucial Role in the case. Media make hue and cry for celebrities , who should act as Law abiding citizen of this Country. It is only procecution who place the case before the court. Mr. Sanjay Dutt case was diluted by the procecution , It was a fact that he had association with terrorist , He was tried for Arms Act only , when He procured the Arms Available with the Notorious gangesters. Courts have their Jurisdictions , who cant go beyond the theory of the proceecution .

I endorse your views.Why can’t we have people friendly police ?The sight of police always fear within.Unless it comes to realize that it’s there to serve the cause of people,it’s not going to strike an intimate chord with common people.

The Supreme Court has expressed grave concern over the way witnesses are threatened by the criminals.The security for the witness has been the top concern for the Apex Court in recent times.

I have already stated that people unnecessarily target the courts if they go out of the way to punish the celebrities.In countries like US there is not much hue and cry when a celebrity is placed behind the bars.In India the story is altogether different.

Majority of cases in U P are not registered, It is with the connivance of the District head , Mean S S P. to keep the crime figurs low. Police has been with collusion with the Criminals. who work as the informers. which result in that criminals remain active, specially with thefts. as they know that no body can apprehand if caught later as when there is no registration of case. with police Station .
