Establish Legal Forums To Help The LitigantsIn our times when unwanted delays ,high cost of litigation ,complex laws and other legal hassles have made legal process nightmarish experience,the initiative of retired judges in form of ‘Aini Saba ‘,a legal forum established in Kolkata, comes as a whiff of fresh air.Contrasting them with the high-profile lawyers who view the client no better than a goose that lays the golden eggs, they seem to be cut above the rest.

Considering the non -availability of high profile lawyers the effort of these retired judges will surely lessen the legal woes of aam aadmi.Needless to say,that under trials ,often innocent,have to undergo harsh ordeal in absence of quality legal service.Against this background, one hopes the efforts of these legal luminaries act as beacon of hope for them.

In a democracy you cannot expect, even justice without a price tag. Even if you get legal assistance, then quality that matter. One of the fascinating fact is that wrong legal advice made by legal experts is not at all a crime. Nowadays court is acting like a politician considering various cases in the court. It always favour who are in power. To get fast justice, we have to pay speed money. Mr. Arvind, nothing going to change in a democracy because permanent vested interest always there. That everybody must be realise. We are living in a hopless democracy.

I agree that we are passing through a very rough phase.However,let’s not become pessimist.Wrong legal advice made by legal experts is certainly a professional misconduct.The Bar Council can take action against such lawyers.

Like to inform you that it’s our constitutional right to have speedy and fair trial.Though wrong elements have made inroad in judiciary too,I still feel most of the judges are still doing a good job.The NJC is bound to reduce the number of corrupt judges.

You raised a very genuine issue. Clients do suffer at the hands of advocates. Clients belonging to deprived sections are the worse victims of greedy lawyers.

@Sumit

Elders always advice us to settle our disputes within themselves in a peaceful manner instead of making it subjudice.It’s a sign of misfortune if an issue needs an advocate!!

Its the tragedy with Indian legal system that you can buy the justice. Legal aid is just like a commodity and you will get quality product by paying the higher price. Many of the innocent accused are convicted due to inefficient advocate because the accused are not in a position to pay higher price of a good advocate.

I agree with your views.Well,justice can be bought anywhere.But new generation lawyers can set better precedents.There can be legal forums to provide speedy and fair trial to under trials.The Bar council should take proper steps against lawyers involved in misuse of law.

Advocacy is a profession and lawyers have to earn their livelihood from the clients. Though the issue you raised is genuine and there should be provision of cheap legal aid for poor accused. There is provision of national Legal services authority for helping the deprived sections of the society but it is not working in true sense.

No doubt lawyers earn money via such clients trapped in various allegations.Yes, the innocents are paying a heavy price for mistakes not committed.There are many legal forums as well for the help of people who cannot afford lawyers but I suspect their real intentions.

@G.S.Johar

Have you challenged the ex-parte judgment in the appellate court?It’s better you challenge the impugned order.

Arvind !

Can the ”AINI SABA” of the retired judges help me in getting the following corrupt judges (of the two consumer courts of Kanpur) punished who, during the entire period of the year 2000 to 2008 openly and successively demanded bribes like ’legal criminals’ and ’licence extortists’ for delivering an ex-parte judgment that was reserved in my favour way back on 16-10-2000. But for flatly refusing to heed their demands the nasty judges eventually, delived judgment in favor of those ex-party OPs who had not even filed their counter W/S, and had also returned the forum notices with the remark ”REFUSED TO ACCEPT”. Here are the names of those judges who behaved like worse than hard core criminals rather than acting as priests of temples of justice :

1. A. H. ANSARI
2. RANVIR SINGH
3. HARCHARAN SINGH GAUTAM
4. S. N. PANDEY

More people die before any dream and there is no sensitivity to nature
Life is crual and the few that make it through this short trip think all is possible for everyone
I know it seems i am off tract but in the big picture i am right on

In nutshell,let’s do all that is possible to make a world a better place.
